These Terms and Conditions govern the offer and sale of products through the website igiardinidigiulia.live. We invite you to read them carefully before proceeding with your purchase. By placing an order, you fully accept the conditions described herein, drawn up in accordance with the Consumer Code (Legislative Decree 206/2005), Legislative Decree 70/2003 on e-commerce, and EU Directive 2011/83/EU.

1. Subject of the Contract

The contract concerns the distance sale of physical products belonging to the following categories:

• Living plants: houseplants, bonsai, tillandsia, rare plants, kokedama, and hydroponically grown plants.
• Preserved greenery: moss pictures and arrangements.
• Terrariums and Kits: glass ecosystems and DIY kits.
• Accessories: pots, plant-care tools, and home décor accessories.
• Events and Business: green party favours (standard and personalised) and corporate gifts.

The images and descriptions on the website are as accurate as possible. However, as these are often natural, living products, each plant is unique: slight variations in shape, colour, or size compared with the photos are completely normal and attest to the authenticity of the product.

2. Purchase Procedure and Conclusion of the Contract

Shopping on our website is simple and secure:

1. Add the desired products to your cart.
2. Access the checkout page, where you can review the order summary, including shipping costs.
3. Enter your billing and shipping details.
4. Choose the payment method and confirm the order.

The sales contract is deemed concluded when you receive an order confirmation email from us containing a summary of your purchases, the order number, and shipping details. We reserve the right not to accept orders in the event that products are unavailable or for other legitimate reasons, in which case we will immediately refund any amount already paid.

3. Prices and Payment Methods

All prices shown on the site are stated in Euros (€) and are understood to include VAT and any other applicable taxes. Shipping costs are not included in the product price, but are calculated and clearly displayed in the cart before the order is completed.

To ensure maximum security and convenience, we offer several trackable payment methods protected by advanced encryption systems:

• Credit/Debit Cards: Visa, Mastercard, Maestro, American Express, Union Pay.
• Digital Payment Methods: PayPal, Apple Pay, Google Pay, Bancontact, iDEAL Wero.
• Installment Payments: via Klarna or PayPal (subject to approval by the service provider).

4. Shipping and Delivery

We know how important it is for you to receive your plants in perfect condition. That is why we entrust our shipments to selected express couriers and use packaging specifically designed to protect every product during transit.

• Processing times: Orders are generally prepared and handed over to the courier within 24/48 business hours of confirmation.
• Delivery times: Delivery usually takes 24/48 hours from the time of shipment (times may vary for islands or remote areas).
• Costs: Shipping is free for orders over € 69.00. For lower-value orders, the cost will be calculated at checkout.

The risk of loss or damage to the goods transfers to you when you physically take possession of the products. If the package shows obvious damage upon delivery, we invite you to accept it "with reservation" or refuse it, contacting us immediately.

5. Right of Withdrawal and Returns

Under Article 52 of the Consumer Code, you have the right to withdraw from the contract within 14 days of receiving the products, without having to provide any reason, for all non-perishable goods (e.g., pots, accessories, preserved greenery, non-personalized favors).

However, your satisfaction is our priority. For this reason, we offer a special “Satisfaction or Refund” Guarantee on live plants in the event of problems upon arrival.

6. Legal Guarantee of Conformity

All non-perishable products sold on our website are covered by the 24-Month Legal Guarantee of Conformity for conformity defects, pursuant to Articles 128 et seq. of the Consumer Code. If you receive a defective product or one that does not conform to the description, you are entitled to restore the conformity of the goods through repair or replacement, at no cost to you.

The warranty does not cover damage caused by improper use, neglect, or normal wear and tear of the product. For live plants, as perishable goods, the warranty applies to the condition in which the product is delivered (see our “Satisfaction or Refund” Guarantee).

7. Limitation of Liability

I Giardini di Giulia S.r.l. undertakes to exercise the utmost care in selecting, packaging, and shipping products. However, we cannot be held responsible for disruptions or delays attributable to force majeure events (e.g., strikes, extreme weather events, pandemics) or courier service disruptions that prevent the order from being fulfilled within the expected time frame.

Under no circumstances shall our liability exceed the total value of the order placed by the customer.

8. Intellectual Property

All content on the website igiardinidigiulia.live, including text, photographs, graphics, logos, trademarks, videos, and layouts, are the exclusive property of I Giardini di Giulia S.r.l. or their respective owners, and are protected by copyright and intellectual property laws.

Any reproduction, modification, distribution, or unauthorized use of such content without our prior written consent is strictly prohibited.

9. Privacy and Processing of Personal Data

Protecting your privacy is fundamental to us. Your personal data is collected and processed in full compliance with Regulation (EU) 2016/679 (GDPR) and applicable Italian law, exclusively to manage your orders and provide you with the best possible service.

10. Applicable Law, Jurisdiction, and ODR

These Terms and Conditions are governed by Italian law. For any dispute relating to the validity, interpretation, or performance of these contracts:

• If you are a Consumer: mandatory territorial jurisdiction lies with the court of the place where you reside or are domiciled, provided it is within Italian territory.
• If you are a Business Customer (with a VAT number): the court with exclusive jurisdiction is the Court of Trani.

We also inform you that the European Commission provides a platform for the alternative out-of-court resolution of online disputes (ODR platform), accessible at http://ec.europa.eu/consumers/odr.

11. Amendments to the Terms and Conditions

We reserve the right to update or amend these Terms and Conditions at any time, to comply with new legal provisions or improve our services. The changes will take effect upon their publication on this page. Orders already placed will be subject to the conditions in force when the contract was concluded.
